Man Sues Samsung After Cell Phone Explodes In His Pocket

Spending too much time on your cell phone can be dangerous for a person’s health, but thanks to one man’s unfortunate accident, we now know that just having your phone on you can be a problem as well.

Jonathan Strobel of Palm Beach County, Florida is believed to be the first person to file a lawsuit against Samsung after he was injured by his Note7 smartphone.

According to ABC 7, Strobel had the phone in the right pocket of his pants when it exploded and caused severe burns on his legs. The 28-year-old’s lawyer told ABC7 he was “in shock and extreme pain due to his injuries.”

The suit was filed for an excess of $15,000 one day after the South Korean company recalled nearly 1 million Note7 phones for their defective batteries.

“He has a deep second-degree burn, roughly the size of the phone, on his right thigh,” Strobel’s lawyer Keith Pierro said Fortune. “Unfortunately for my client the recall came too late.”

Samsung Electronics America President and COO Tim Baxter released a video statement after the government-sanctioned recall was announced following more than 90 complaints of batteries overheating.

“With battery cell defects in some of our Note7 phones, we did not meet the standard of excellence that you expect and deserve,” he said. “We apologize, especially to those of you who were personally affected by this.”
